By downloading, accessing, or using the Around the Town scavenger hunt mobile application (the “App”), you agree to the terms and conditions below. If you do not agree to these Terms of Use, you may not access or use the App.

Participation in the Around the Town scavenger hunt requires walking and other physical activity, is voluntary, and involves certain risks, including potential hazards associated with outdoor activities, pedestrian traffic, and varying weather conditions.

HV Global Group, Inc. and WHV Resort Group, Inc. (collectively, “HVC”), WHV Hospitality Management, Inc., HV Global Management Corporation, the applicable owners’ association(s) of the resort and their respective affiliates (hereinafter collectively referred to as “HVC Related Entities”) are not the owners or developers of the App, do not have direct control over the App or guarantee the continuous availability, accuracy, or functionality of the App, and are not liable for matters that arise as a result of your participation in the scavenger hunt or use of the App, including the purchase, use, or consumption of products and services via the App in connection therewith. The App may include content provided by HVC Related Entities or other parties, including materials provided by other users. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content other than the content provided by HVC Related Entities, are solely the opinions and the responsibility of the person or entity providing those materials. You are responsible for your own actions and conduct while using the App and while participating in the scavenger hunt. You assume complete responsibility for your use of the App and release HVC Related Entities and their affiliates from all potential claims and damages that may result from such use. HVC Related Entities do not sponsor or endorse the products or services offered in or use of the App. The availability of the App or the scavenger hunt does not imply any sponsorship or endorsement of the App or the developer by HVC Related Entities.

When using the App, you may be required to provide personal information or grant permissions to access certain device features, such as location services. Please review the App’s privacy policy and terms of use to understand how your data will be collected, stored, and used. HVC Related Entities bear no responsibility for any data breaches or misuse of personal information by the App’s developer.

ANY INFORMATION OR MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE APP IS AT YOUR OWN DISCRETION AND RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE’S SYSTEM, LOSS OF DATA, OR ANY OTHER LOSS THAT RESULTS FROM DOWNLOADING OR USING ANY SUCH MATERIAL.

HVC RELATED ENTITIES AND THEIR AFFILIATES SHALL NOT BE HELD LIABLE FOR ANY AND ALL ACTIONS, COSTS, SUITS, DEMANDS, CLAIMS, DAMAGES, LOSSES AND LIABILITIES (INCLUDING REASONABLE ATTORNEY’S FEES) ARISING, DIRECTLY OR INDIRECTLY, FROM YOUR PARTICIPATION IN THE SCAVENGER HUNT, INCLUDING, BUT NOT LIMITED TO, FOR ANY ERRORS OR OMISSIONS IN THE SCAVENGER HUNT, OR FOR ANY OFFENSE, INJURY, DEATH, LOSS, OR DAMAGE OF ANY KIND INCURRED OR SUFFERED AS A RESULT OF SUCH PARTICIPATION.

BY USING THE APP FOR THE SCAVENGER HUNT, YOU ALSO CONFIRM YOU HAVE COMPLETED AND AGREED TO THE ACTIVITIES RELEASE FORM, WHICH IS AVAILABLE AT YOUR RESORT.
